Qualifying Investors

  1. Professional Investors – An individual or entity who controls at least $10 million of investments, securities, or holds an Australian Financial Services Licence.
  2. Sophisticated Investors – An individual who has aggregated net assets of $2.5 million, or has aggregated gross income for each of the last two financial years of at least $250,000 a year. A qualified accountant must certify the person satisfied one of these criteria and this certification must be renewed every two years.
  3. Experienced Investors – Where an AFSL holder such as Baillie Asset Management is satisfied on reasonable grounds that the person to whom the offer can be made has previous experience in investing in securities that allow them to assess
    • merits of the offer
    • value of the securities
    • risks involved in accepting the offer
    • their own information needs, and
    • adequacy of the information given by the person making the offer.

Anti-Money Laundering

The Australian Government has implemented Anti Money Laundering and Counter Terrorism Financing (AML/CTF) legislation designed to reduce the opportunity of money being generated through illegal activity from being converted into legitimate or clean funds. By combating money laundering, the government also aims to reduce crime and prevent the use of funds to finance terrorist activity.

The Australian Transaction Reports and Analysis Centre (AUSTRAC), the Government regulator for anti-money laundering and counter terrorism financing, have developed a flyer to help investors better understand the new legislation – click to download.

Baillie Assets Management Limited complies with its AML obligations and has an AML compliance program in place.

The Australian financial services industry is required to capture and retain specific customer information for new clients applying for products and services. This process is generally referred to as ‘know your customer’ or KYC.

Baillie, along with the majority of financial services organisations, will be using new identification forms to fulfil our obligations in this respect.

The new identification forms capture information relevant to the client/customer type and no new accounts can be opened without the appropriate form being completed.
